Professional Liability


  • Engineering negligence: Recovered $16 million in construction and design defect claim involving multiple parties and complicated issues of liability, damages and insurance coverage. The client owned and operated a valuable asset that had been poorly designed and constructed. 

 

  • Recovered for insurance broker’s failure to procure workers compensation insurance that left the State of Kansas to pay for the catastrophic loss.  Recovery provided $3.3 million cash and relieved the State of Kansas from paying future medical care of approximately $8 million.

 

  • Legal malpractice:  Obtained $200,000 for client after her attorney failed to secure debt from a divorce. The former husband filed bankruptcy and avoiding paying property settlement.

 

  • Medical negligence:  Obtained $200,000 for young patient whose cancer was not timely diagnosed leading to additional medical procedures.

 

  • Medical negligence:  Obtained confidential settlement for our client who suffered amputation as a result of failure to monitor Coumadin and failure to timely diagnose blood clots.

 

  • Medical negligence:  Recovered a cash payment plus financial benefits for 25 years for two young children that lost their father after he suffered a traumatic brain injury and died after weeks in the hospital. Settled with the father’s neurosurgeon for failing to timely diagnose and treat the father’s head injury.

 

  • Broker negligence and Directors and Officers negligence:  Recovered a $1.045 million partial settlement after being retained by the Court-appointed bankruptcy trustee in the Brooke Corporation bankruptcy to prosecute broker liability claims valued at over $13 million for the former directors and officers of the Brooke entities for the brokers’ failure to procure adequate liability coverage for the directors and officers.   • Medical negligence:  Represented a construction worker who suffered a traumatic brain injury when he fell off of scaffolding onto the concrete floor below.  After brief litigation, secured a settlement on behalf of the injured worker that helped him to maintain his independence.

 

  • Medical negligence:  Recovered $70,000 for injury suffered when hospital crash cart not properly equipped with epinephrine.
